Terms & Conditions

01 Location

Stand spaces are allocated by the Organisers (T&SF) as fair as possible on a first come-first served basis. There is no guarantee about the location of your stand in relation to any other Trader (Unless selling similar products). Stands will be pegged and Traders may not move these pegs or occupy space outside the space they have booked. It is the responsibility of the Trader to check the stand number before unloading to ensure that exhibits are placed on the stand allocated to them. T&SF will not be held responsible for stands erected in the wrong location. Please be aware that trade stand space is on grass, so some uneven areas may be encountered.

02 Timing

Setting-up and dismantling times will be confirmed nearer the event via email. Traders must NOT break down their displays before an announcement by T&SF staff before packing up (this is expected to be around 5:00pm).

All Traders will be given an allocated time of arrival to the event. (All times before 9:30am) Anyone arriving after 9am will be refused access and will not receive a refund of their pitch. Please use the EMERGENCY CONTACT on the day if you have any issues.

03 Refreshments

Food and drink will be available for purchase on-site from food & drink Traders throughout the day.

04 Licensing

An Event Licence from North Yorkshire Council has been applied for in accordance with the Licensing Act 2003.

05 Representatives

Stands may not be shared or sub-let under any circumstances

06 Electrical Equipment

Traders may not play music, use PA systems or make any other noise at a level which will cause annoyance to adjoining Traders.

07 Literature

Traders may only distribute any literature from their own stand. Non-exhibitor’s sales literature is prohibited from the event.

08 Waste

It is the responsibility of each Trader to dispose of ALL waste/rubbish that is generated. Rubbish is NOT ALLOWED to be left on the trade stand pitch, but if there is space within the Festival bins provided, you may use these so long as rubbish is separated into the correct bins provided.

09 Payment Terms

Payment upon booking only. In the unlikely event of cancellation of the event due to unforeseen circumstances, our full liability will be limited to refunding the fees paid. If a Trader wishes to cancel their booking for any reason, all fees paid up to 1st May will be refunded. Thereafter all fees are non-refundable

10 Liability

Traders’ staff shall comply with all applicable Health & Safety and Fire Regulations. Thirsk & Sowerby Festival,Thirsk Town Council and The Sowerby Flatts Association accept no responsibility whatsoever for any injury, loss or damage to exhibitors’ staff and equipment. Traders should arrange adequate insurance cover for themselves, their staff, products and equipment and for consequential claims or third party losses.Traders shall also indemnify the aforesaid Organisations from and against all expenses, liabilities, losses, claims or proceedings whatsoever as a result of personal injury to or the death of any Visitor or Venue or Association

11 Removal

TSF reserve the right to require the stall holder to remove its stand immediately without any refund if TSF have reason to believe that the stall holder is in breach of any Laws or Regulations enforceable by the local authority’s Trading Standards Department.

12 Festival Etiquette

Thirsk and Sowerby Festival are able to issue warnings and bans to their traders based on inappropriate behaviour, including but not limited to, Social media posts that may reflect on the Festival in a bad light, strong language and anything that could be deemed as affecting the safety or wellbeing of other stall holders, volunteers, event organisers or the event itself.

13 Obligation

The stall holder agrees to obey any reasonable instructions given to the stall holder by or on behalf of the festival in connection with the stand.

14 Duplication

We (Thirsk and Sowerby Festival) will be accepting one or more stallholders selling the same/similar products to sell at the event, but will ensure traders selling the same products are spread across the stalls area of the event to the best of our ability

15 Equipment

Thirsk and Sowerby Festival do not provide electricity provision, tables, gazebos or anything that a vendor may need on the day and this must be provided by the vendor and Thirsk and Sowerby Festival accept no responsibility for any damages or losses on the day.
